Making Tax- Free Gifts from IRA Accounts

Leaving money in your estate to a charity, such as Daily Bread, is a noble and selfless act. But making a gift from estate assets while you're still alive may be more satisfying.

A provision in the pension reform legislation President Bush signed in August, 2006, makes it easier for senior citizens to donate money in their Individual Retirement Accounts (IRAs) to charity. The provision --- which is effective only for 2006 and 2007 --- allows individuals who are 70 1/2 or older to transfer tax-free withdrawals from their IRAs to charitable organizations. (Please note that this provision applies only to IRAs and does not apply to pension funds, 401K’s or 403(b) plans.)
Ordinarily, when you withdraw money from your IRA, it becomes part of your taxable income for the year. This new law allows older taxpayers to donate from their IRAs up to $100,000 tax-free each year to charitable causes. (Note: Since you receive the considerable benefit of not being taxed on the withdrawal of funds for the IRA charitable rollover, you are not permitted to claim an income-tax deduction as well.)

To benefit, you must act on this soon since it is a temporary measure only in effect until the end of 2007. Contact your attorney if you need advice on making an IRA Charitable Rollover gift.
